These Terms of Service (“Terms”) govern your access and use of the website www.thekriptstore.com and any affiliated subdomains (collectively, the “Services”), operated by THE KRIPT (“we”, “us”, “our”). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy.

The Services are powered by Shopify, Inc., which provides our e-commerce platform.

1. Eligibility & Account Responsibilities

By using the Services, you represent that:

• You are at least the age of majority in your jurisdiction;
• Any minors using the Services do so with your permission;
• The information you provide (email, shipping details, billing information) is accurate and complete.

You are responsible for safeguarding your account credentials. We may suspend or terminate any account that violates these Terms or is involved in suspicious activity.

2. Our Products

We make reasonable efforts to display products accurately, including colors and details. However, due to device settings and lighting, products may appear slightly different in person.

We do not guarantee that any product will meet your personal expectations. Product descriptions, availability, and pricing may change at any time.

We reserve the right to limit quantities, discontinue products, or restrict sales to certain regions or customers at our discretion.

3. Orders & Acceptance

Placing an order constitutes an offer to purchase. We may accept or decline your order at our sole discretion.

An order is considered accepted only when we send an order confirmation email. We may cancel or modify orders for reasons including:

• Product unavailability;
• Pricing or description errors;
• Suspected fraud or resale activity;
• Issues verifying payment information.

All returns and refunds are governed by our Refund & Return Policy.

3.1 No Resale or Export

You agree that products purchased from THE KRIPT are for personal use only and will not be resold or exported commercially. We may cancel orders that appear to be placed by dealers, distributors, or bulk purchasers.

4. Prices, Taxes & Billing

Prices may change without notice. The price charged will be the price shown at checkout at the time of purchase.

Unless stated otherwise, prices do not include taxes, duties, tariffs, brokerage fees, or international import fees.

By submitting payment, you represent that:

• Your payment information is accurate and authorized;
• Your payment provider will honor the charges;
• You agree to pay all amounts shown at checkout, including shipping and taxes.

Orders may be subject to fraud screening. We reserve the right to cancel orders that cannot be verified.

5. Shipping, Delivery & Customs

Shipping methods, costs, and estimated delivery times are displayed at checkout. All delivery times are estimates only.

Once your order is transferred to the carrier, title and risk of loss pass to you. We are not responsible for:

• Carrier delays or errors;
• Packages marked “delivered” but not received;
• Customs delays or holds;
• Incorrect shipping details provided by the customer.

5.1 Customs Duties, Taxes & Import Fees

International customers (outside the USA & Canada) are responsible for all customs duties, taxes, import fees, and brokerage charges.

These charges are non-refundable unless required by local law (e.g., certain UK/EU statutory rights).

6. Intellectual Property

All content on the Services—including text, images, logos, graphics, video, and design—is owned by THE KRIPT or its licensors and protected by global intellectual property laws.

You may use the Services only for personal, non-commercial purposes. You may not copy, modify, distribute, or create derivative works without our written permission.

7. Third-Party Tools & Links

We may offer third-party tools or links as part of the Services. These are provided “as is” without warranty. We are not responsible for the accuracy, functionality, or content of third-party websites or tools.

Your use of third-party services is entirely at your own risk.

8. Relationship with Shopify

The Services operate on Shopify’s commerce platform. However, all transactions and customer interactions are solely between you and THE KRIPT.

You release Shopify from any claims related to your purchases or use of the Services.

9. Feedback & User Content

By submitting reviews, photos, suggestions, or other content (“Feedback”), you grant THE KRIPT a worldwide, perpetual, royalty-free license to use, publish, modify, and distribute such content.

You warrant that you own or have rights to the Feedback and that it does not violate any third-party rights.

10. Errors & Omissions

We reserve the right to correct errors, inaccuracies, or omissions at any time, including after an order has been placed. Orders affected by such errors may be canceled or updated.

11. Prohibited Uses

You may use the Services only for lawful purposes. Prohibited activities include:

• Fraud or unauthorized transactions;
• Harassment or abuse of customers or staff;
• Uploading malware or malicious code;
• Scraping, crawling, or harvesting data without permission;
• Interference with security or website operations.

12. Returns, Refunds & Final Sale Rules

All returns are handled according to our Refund & Return Policy. The following rules apply:

• Returns must be initiated within 14 days of delivery.
• Items must be unworn, unused, with tags attached, and in original packaging.
• Final Sale items are non-returnable for customers outside the UK/EU.
• For UK/EU customers: Final Sale clothing is returnable under statutory cooling-off laws, except:
  • Underwear
  • Swimwear
  • Bodysuits
  • Items with broken hygiene seals

Duties, tariffs, and taxes are non-refundable unless required by local law.

13. UK Consumer Rights

Customers in the United Kingdom have statutory rights under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013.

13.1 UK 14-Day Statutory Cancellation

You may cancel your order within 14 days of delivery for any reason. You must notify us clearly by email.

You will receive a refund of:

• The price paid for the goods;
• The cheapest standard delivery cost available at checkout.

You are responsible for return shipping unless the item is defective.

13.2 UK Non-Returnable Items

• Underwear, swimwear, bodysuits, and hygiene-sensitive items once unsealed;
• Custom or personalized items;
• Goods mixed with other items after delivery.

14. EU Consumer Rights

If your order is delivered to the European Union, you have a 14-day cooling-off period under EU law.

You will receive a refund of:

• The product price;
• The cheapest standard shipping cost.

You are responsible for paying return shipping unless the product is defective.

Duties/taxes are refunded only where required by local law.

15. Force Majeure

We are not liable for delays or failures caused by circumstances beyond our control, including natural disasters, war, labor disputes, shipping disruptions, or governmental actions.

16. Disclaimer of Warranties

The Services and all products are provided “as is” without warranties of any kind.

We do not guarantee that:

• The Services will be uninterrupted or error-free;
• Products will meet your personal expectations.

UK/EU customers: This disclaimer applies only to the extent permitted by mandatory consumer protection laws.

17. Limitation of Liability

To the fullest extent permitted by law, THE KRIPT is not liable for indirect or consequential damages, including lost profits or data.

Our total liability shall not exceed the amount paid for the product giving rise to the claim.

UK/EU customers: We do not exclude liability for death, personal injury, fraud, or other rights that cannot be waived.

18. Arbitration & Class Action Waiver (Non-UK/EU)

This section applies only to customers outside the UK/EU.

Disputes must be resolved via individual arbitration. Class actions and collective proceedings are waived.

UK/EU customers retain their statutory rights to use local courts.

19. Severability

If any provision is found unenforceable, the remaining parts remain in effect.

20. Governing Law

These Terms are governed by the laws of the jurisdiction where THE KRIPT is headquartered.

UK/EU customers may rely on mandatory consumer laws of their home country.

21. Updates to These Terms

We may update these Terms at any time. Changes become effective upon posting. Continued use of the Services constitutes acceptance.
